SilverWay Bank - Terms and Conditions of Service

1. Introduction and Acceptance

Welcome to SilverWay Bank ("SilverWay," "we," "us," or "our"). By creating an account, accessing our services, or using our digital banking platform, you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and SilverWay Bank.

If you do not agree to these Terms, you must not use our services. By clicking "I Agree" or by continuing to use our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Account Opening and Eligibility

To open a SilverWay Bank account, you must:

  • Be at least 18 years of age
  • Provide accurate and complete personal information
  • Have a valid email address and phone number
  • Complete identity verification as required by law
  • Agree to comply with all applicable laws and regulations

We reserve the right to refuse account opening or to suspend or terminate accounts at our sole discretion, particularly if we suspect fraud, illegal activity, or violation of these Terms.

3. Account Types and Services

SilverWay Bank offers the following services:

  • Fiat Accounts: Multi-currency accounts for holding USD and other supported currencies
  • Money Transfers: Domestic and international money transfers
  • Virtual and Physical Cards: Instant virtual cards and physical debit cards
  • Loans and Credit: Personal and business loans up to $60,000,000
  • Investment Services: Cryptocurrency and stock trading
  • Payment Processing: Send and receive payments globally

4. Deposits and Withdrawals

You may deposit funds into your SilverWay account through:

  • Bank transfers (ACH, wire transfers)
  • Debit or credit card payments
  • Third-party payment processors
  • Direct deposits from employers or other sources

Withdrawals may be subject to verification procedures, processing times, and limits. All withdrawal requests must comply with applicable anti-money laundering (AML) and know-your-customer (KYC) regulations. We reserve the right to delay or deny any withdrawal that we believe may be fraudulent or in violation of these Terms.

5. Loans and Credit Services

SilverWay Bank offers loan products with the following terms:

  • Maximum loan amount: $60,000,000
  • Interest rate: 5% fixed annual percentage rate (APR)
  • Repayment terms: 3, 6, 12, or 24 months
  • Auto-disbursement: Approved loans are automatically disbursed within 10 minutes

By applying for a loan, you agree to:

  • Provide accurate income and employment information
  • Repay the loan according to the agreed schedule
  • Pay all applicable interest and fees
  • Accept that late payments may result in penalties and negative impact on your credit

Loan approval is subject to SilverWay's internal risk assessment and may require additional documentation.

6. Fees and Charges

SilverWay Bank may charge fees for certain services, including but not limited to:

  • International wire transfer fees
  • Currency conversion fees
  • Physical card issuance and replacement fees
  • ATM withdrawal fees (out-of-network)
  • Late loan payment fees

A complete fee schedule is available on our website. We reserve the right to modify fees with 30 days' prior notice.

7. Security and Account Protection

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Notifying us immediately of any unauthorized account access
  • Using strong passwords and enabling two-factor authentication
  • Ensuring your contact information is up-to-date

SilverWay employs bank-grade 256-bit SSL encryption and real-time fraud monitoring to protect your account. However, you acknowledge that no security system is completely secure, and SilverWay is not liable for unauthorized access resulting from your failure to secure your credentials.

8. Prohibited Activities

You agree not to use SilverWay Bank for:

  • Illegal activities, including money laundering or terrorism financing
  • Fraudulent transactions or identity theft
  • Violating any applicable laws or regulations
  • Conducting transactions related to prohibited goods or services
  • Attempting to access another user's account without authorization

Violation of this section may result in immediate account suspension, termination, and reporting to law enforcement authorities.

9. Privacy and Data Protection

SilverWay Bank is committed to protecting your personal information. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and share your data. By using our services, you consent to our data practices as described in the Privacy Policy.

We may share your information with:

  • Financial institutions to process transactions
  • Credit bureaus for loan applications
  • Government authorities when required by law
  • Third-party service providers who assist in operating our platform

10. Regulatory Compliance

SilverWay Bank operates in compliance with:

  • Federal banking regulations
  • Anti-Money Laundering (AML) laws
  • Know Your Customer (KYC) requirements
  • Consumer Financial Protection Bureau (CFPB) guidelines
  • Bank Secrecy Act (BSA)

You agree to cooperate with all verification and compliance requests, including providing identification documents and proof of address when requested.

11. Limitation of Liability

To the fullest extent permitted by law, SilverWay Bank shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Service interruptions or technical failures
  • Third-party actions or failures
  • Losses resulting from your violation of these Terms

Our total liability to you for any claim shall not exceed the amount of fees paid by you to SilverWay in the twelve (12) months preceding the claim.

12. Dispute Resolution and Arbitration

Any disputes arising from these Terms or your use of SilverWay Bank services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits against SilverWay Bank.

13. Account Termination

You may close your account at any time by contacting customer service. SilverWay reserves the right to suspend or terminate your account if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • Required by law or regulatory authorities
  • Your account has been inactive for an extended period

Upon termination, you must repay any outstanding loans and return any physical cards. Remaining balances will be returned to you via bank transfer.

14. Modifications to Terms

SilverWay Bank may modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
